Federal Grand Jury In Fort Wayne Returns Indictment

Fort Wayne, INCThe United States Attorney's Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following Indictment on Feb. 27, 2013:

Curtis Wittwer, 65, of Spencerville, Indiana, is charged in a four count Indictment with two counts of maintaining a drug-involved premises from on or about Sept. 12, 2012, to on or about Sept. 25, 2012, possessing a firearm in furtherance of a drug trafficking crime, and being an unlawful user of a controlled substance in possession of a firearm on or about September

25, 2012. The Indictment also seeks forfeiture of U.S. currency, firearms and ammunition. These charges were filed as the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Indiana State Police, IMAGE Drug Task Force, Allen County Police Department and the DeKalb County Prosecutor’s Office. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller.

The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.

If convicted in court, any specific sentence to be imposed will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
