BOISE - Jesse Scott Fleming, 24, of Garden City, Idaho, pleaded guilty today in United States District Court in Boise to unlawfully possessing a firearm, U.S. Attorney Wendy J. Olson announced.
According to the plea agreement, Fleming was arrested after he attempted to sell marijuana to an undercover police officer on Sept. 17, 2012. After he was arrested officers discovered a sawed-off shotgun in Fleming’s vehicle. Fleming admitted to possessing the sawed-off shotgun. Fleming is also prohibited from possessing firearms because he was previously convicted of the felony crime of aggravated assault in 2009.
The charge is punishable by up to ten years in prison, a maximum fine of $250,000, and up to three years supervised release. The Government is also seeking forfeiture of the sawed-off shotgun.
Sentencing is set for July 25, 2013, before Chief U.S. District Judge B. Lynn Winmill at the federal courthouse in Boise.
The case was investigated by the Ada County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives. The case is being prosecuted by the Special Assistant U.S. Attorney hired by the Treasure Valley Partnership and the State of Idaho to address gang crimes. The Treasure Valley Partnership is comprised of a group of elected officials in southwest Idaho dedicated to regional coordination, cooperation, and collaboration on creating coherent regional growth.
