HHS Secretary Xavier Becerra was quoted in the HHS release, "The Biden-Harris Administration continues to take actions to protect patients from junk health insurance and unfair billing practices." According to the HHS press release, The proposed rule aims to streamline communications between healthcare providers and insurance payers, adjust Federal IDR timelines, and introduce a more equitable administrative fee structure. The goal is to make the IDR process more efficient and accessible, protecting consumers from surprise medical bills.

HHS Secretary Xavier Becerra emphasized the importance of taking patients out of the middle of billing disputes, stating, "This rule is the next step in ensuring we take patients out of the middle of billing disputes between insurers and healthcare providers."

The proposed rule includes several key changes to the surprise billing dispute process. Payers will be required to provide additional details at the time of initial payment or denial, using standardized codes to clarify whether a claim is subject to the provisions of the No Surprises Act (NSA). These changes aim to reduce the number of ineligible disputes that enter the IDR process.

Furthermore, the administration is proposing revisions to the open negotiation process. Parties will now use the Federal IDR portal for all communications, reducing uncertainties and encouraging more meaningful negotiations before entering the formal dispute resolution stage.

The proposal also introduces new batching provisions, allowing multiple items or services to be included in a single dispute. Additionally, an eligibility review process will be implemented to expedite eligibility determinations.

Centers for Medicare & Medicaid Services Administrator Chiquita Brooks-LaSure added to the HHS press release by stating, "The No Surprises Act continues to protect consumers from surprise medical bills. The Biden-Harris Administration continues to demonstrate a commitment to implementing the law for the American people."

The proposed rule is part of the administration's ongoing efforts to improve the healthcare system and ensure that patients are not burdened by unexpected medical bills. By streamlining the IDR process, enhancing communication between providers and payers, and introducing a more equitable fee structure, the administration aims to make the system more efficient and accessible, ultimately benefiting patients across the country.
