The U.S. Department of Labor has recovered $170,439 in back wages for 60 workers who were denied overtime pay by KDK Transport Co., a non-emergency medical transport company based in Coeburn, Virginia. The Wage and Hour Division's investigation revealed that the company erroneously applied the Motor Carrier Exemption, failing to combine all hours worked by drivers, including driving and wait times, when calculating total weekly hours for overtime wages. This oversight resulted in violations of the Fair Labor Standards Act (FLSA), which mandates time-and-a-half pay for non-exempt employees working over 40 hours per week.

“Companies must understand their legal responsibilities and obligations to pay employees all of their earned wages,” stated John DuMont, Wage and Hour Division District Director in Pittsburgh. “The Wage and Hour Division has professionals ready to assist employers in avoiding compliance issues.”

Employers seeking guidance can contact the Wage and Hour Division at its toll-free number, 1-866-4-US-WAGE. The division also provides various online resources for employers, including a fact sheet on FLSA wage laws and overtime requirements. Workers who believe they are not receiving their due wages can reach out to a local Wage and Hour Division representative via an interactive online map available on the agency’s website. Additionally, both workers and employers can ensure accurate tracking of hours worked by downloading the department’s free Android Timesheet App.
