EPA reaches $100,000 settlement with Hyponex Corp. for Clean Water Act violations

The U.S. Environmental Protection Agency (EPA) has announced a $100,000 settlement with Hyponex Corp., a subsidiary of The Scotts Miracle-Gro Co., located in Shreve, Ohio. This settlement resolves alleged violations of the Clean Water Act related to pollutant discharges.

According to the EPA, Hyponex Corp. discharged pollutants including E. coli, total suspended solids, chlorine, and ammonia-nitrogen above permitted limits into the Kiser Ditch tributary, which flows into the Lower Muddy Fork Mohican River. In May 2022, the EPA issued an administrative order requiring the company to submit a plan to comply with and prevent future exceedances of effluent limits. The company completed all required actions and returned to compliance by September 2022.
