ACT | The App Association has submitted an amicus brief to the Ninth Circuit Court of Appeals, supporting Google's request for a stay on an injunction until an appeal is resolved. This action follows a district court's decision to issue a permanent injunction that could disrupt the app ecosystem and impact small business developers using Google Play.
Morgan Reed, President of ACT | The App Association, stated, “The district court’s injunction would make significant changes to the app ecosystem small businesses rely on. As it stands, the injunction treats apps like mere inventory, plugging them into third-party stores they’ve had no prior relationship with and leaving it up to developers to sort out payment, security, and other issues. Courts should not use small businesses as beta testers on a project with major design flaws, particularly as the appeals process plays out.”
The association highlights potential increased costs for thousands of developers who would face new quasi-contractual relationships with unfamiliar third-party app stores due to the injunction's requirements.
ACT | The App Association emphasizes the necessity for a stay during the appeal process and details specific complications in their brief. They intend to continue advocating for solutions favorable to small businesses throughout this period.
