A Fort Myers man has been sentenced to five years and five months in federal prison for possession with intent to distribute fentanyl. This follows an investigation by Homeland Security Investigations (HSI) Fort Myers.
Nicholas Smith, 45, was found guilty after a bench trial on August 21, 2024. According to court documents, officers from the Fort Myers Police Department stopped Smith on September 5, 2023, for multiple traffic infractions near Winkler Avenue and Fowler Street. During a search, officers discovered a large plastic bag containing 11 smaller bags of a pink powdery substance. The substance tested positive for para-Fluorofentanyl and fentanyl, weighing 9.55 grams.
The case was investigated by HSI Tampa and the Fort Myers Police Department and prosecuted by Assistant U.S. Attorney Patrick L. Darcey.
