An international enforcement operation has led to the arrest of five Guatemalan nationals linked to a 2021 incident in Chiapas, Mexico. The event involved a semi-trailer truck crash that resulted in the deaths of over 50 migrants and injured more than 100 others. Many victims were Guatemalan nationals.
The arrests were part of a coordinated effort between the U.S. Department of Justice and Guatemalan authorities, coinciding with the third anniversary of the tragic event. Jorge Agapito Ventura, one of those arrested, is expected to appear before U.S. Magistrate Judge Andrew Edison.
Other individuals arrested include Tomas Quino Canil, Alberto Marcario Chitic (also known as Alberto De Jesus), Oswaldo Manuel Zavala Quino (also known as Osvaldo ZQ), and Josefa Quino Canil De Zavala. They have been indicted in connection with facilitating migrant travel from Guatemala through Mexico to the United States.
"The Justice Department is holding accountable the individuals who we allege preyed on vulnerable migrants," said Attorney General Merrick B. Garland. "Human smugglers should heed these charges and arrests as a warning: you will be held accountable for your deadly crimes."
Secretary of Homeland Security Alejandro N. Mayorkas stated, "Today, the alleged perpetrators... are being held accountable... DHS will continue to disrupt and dismantle illegal human smuggling operations."
U.S. Attorney Alamdar S. Hamdani emphasized their commitment to pursuing justice across borders: "Our investigation into this catastrophic event... signifies the unwavering commitment... to hold those who engage in human smuggling accountable."
Principal Deputy Assistant Attorney General Nicole M. Argentieri highlighted that "the defendants conspired to smuggle Guatemalan migrants," resulting in some fatalities during transit.
Katrina W. Berger from Homeland Security Investigations praised collaborative efforts: "HSI remains committed to dismantling human smuggling networks that exploit and mislead migrants."
The operation was supported by various agencies including HSI’s Global Investigation Group, Customs and Border Protection National Targeting Center, DHS Operation Sentinel, and others.
Assistant U.S. Attorney Jennifer Day for Southern District of Texas leads prosecution efforts alongside Trial Attorney Danielle Hickman from Human Rights and Special Prosecutions Section.
Joint Task Force Alpha (JTFA), established by Merrick B. Garland in June 2021, played a crucial role in these developments by focusing resources on combating human smuggling activities across multiple regions.
To date, JTFA's initiatives have resulted in numerous arrests and convictions related to human smuggling offenses.
An indictment remains an allegation until proven guilty beyond reasonable doubt in court.
