New Hampshire firm sentenced for illegal silencer distribution

A New Hampshire company, KBC Capital, LLC, doing business as "Lethal Eye," has been sentenced for violating the National Firearms Act (NFA) by distributing components that could be used to assemble firearm silencers. The sentence was delivered by U.S. District Court Chief Judge F. Dennis Saylor IV, who imposed a three-year probation and a $260,000 fine on the company following its guilty plea in September 2024 to 26 counts of illegal firearm transfer.

Acting United States Attorney Joshua S. Levy emphasized the impact of silencers on criminal activity, stating, "Silencers allow for the proliferation in criminal activity by reducing the sound of gunfire and affecting the ability to identify the location and source of a shot." He added that KBC's actions "flooded our streets with dangerous devices and impeded law enforcement."

James M. Ferguson from the Bureau of Alcohol, Tobacco, Firearms & Explosives (ATF) noted that suppressors pose significant threats when misused. "Today’s sentence reinforces ATF’s commitment to arresting and prosecuting individuals who violate the NFA statutes," he said.

Michael J. Krol from Homeland Security Investigations highlighted the responsibility companies have in adhering to firearms regulations: “Companies in the firearms trade have a duty to follow regulations to ensure a safe, lawful firearms industry."

Ketty Larco-Ward from the United States Postal Inspection Service affirmed their role in preventing illicit distribution through postal services: “The sentence handed down in this case serves as a reminder that postal inspectors... remain steadfast in our resolve to protect our communities from dangerous weapons.”

Stephen Belleau from the Drug Enforcement Administration stressed their ongoing efforts with law enforcement partners against illegal activities: “We will continue to work with our law enforcement partners to stop illegal activities so our communities can be safe places to be.”

KBC operated under "Lethal Eye" online, marketing products like a “muzzle break” which functioned as parts of firearm silencers. The investigation revealed 327 illegal silencer items at their premises during an August 2023 search. KBC did not hold a Federal Firearms License nor paid taxes required for manufacturing silencers.

The announcement was made by U.S. Attorney Levy along with other officials including ATF SAC Ferguson and HSI SAC Krol. Assistance came from local police departments in Nashua and Hollis.
