The NFIB Small Business Legal Center has been active in filing amicus briefs in courts across the United States during November and December. These filings address significant issues affecting small businesses.
One case, Mayfield v. DOL, is being heard at the Fifth Circuit Court of Appeals. The brief argues that the Department of Labor lacks the authority to set a salary threshold for determining overtime eligibility for executive, administrative, or professional employees.
Another case, Corner Post v. Federal Reserve, filed at the U.S. District Court for the District of North Dakota, challenges swipe fees established by the Federal Reserve.
In Dale v. AU Medical Center, filed at the Georgia Supreme Court, the brief contends that an action is initiated when a lawsuit is filed rather than at trial time. It also argues that defendants should not lose their ability to assign responsibility if they are still involved as defendants by trial date.
The NFIB Small Business Legal Center's mission is to defend small business owners' rights in courtrooms nationwide. The organization is currently participating in over 40 cases in both federal and state courts, including proceedings before the U.S. Supreme Court.
