Court decision impacts future broadband policies

Following a recent decision by the Sixth Circuit Court of Appeals on Title II, the Information Technology and Innovation Foundation (ITIF) has issued a statement. The ITIF is recognized as a leading think tank in science and technology policy.

Joe Kane, Director of Broadband and Spectrum Policy at ITIF, commented on the ruling: "The Sixth Circuit's ruling is a clear victory for consumers and innovation. The court’s decision to strike down the FCC’s Title II Order heads off an ill-suited regulatory regime that would have been a drag on the growth and development of the Internet."

Kane further elaborated on misconceptions regarding broadband regulation: "Contrary to some misguided rhetoric, treating broadband like the old telephone monopoly would not have promoted a free and open Internet. Instead, it would have jeopardized the progress that has delivered unprecedented connectivity, speeds, and choice to consumers over the decades."

With this ruling providing clarity on Title II's unsuitability for internet regulation, Kane suggests that focus should shift: "Now that there is clarity that Title II is wrong for the Internet, the new FCC Chairman should put this waste of time behind us and shift the agency’s focus to policies that benefit consumers, not partisanship."
