A federal grand jury in Greenville has indicted Sergio Ixtepan-Toto, a 36-year-old Mexican national, for unlawful entry into the United States. Ixtepan has been deported three times previously.
Court documents reveal that on December 6, 2024, officers from the Pickens Police Department arrested Ixtepan on charges of driving under the influence. A review of his immigration file indicated prior deportations in May 2020, November 2022, and February 2024. Re-entry into the U.S. would require permission from the Attorney General, which records show Ixtepan did not obtain. He also faces multiple charges of driving under the influence and domestic violence.
Ixtepan was arraigned before United States Magistrate Judge Kevin McDonald.
The investigation was conducted by U.S. Immigration and Customs Enforcement, the Department of Homeland Security, and the Pickens Police Department. Assistant U.S. Attorney Max B. Cauthen is handling the prosecution.
It is important to note that all charges are accusations at this stage, and defendants are presumed innocent until proven guilty beyond a reasonable doubt in court.
