Cody Lynn Lusk, a 34-year-old resident of Henryetta, Oklahoma, has pleaded guilty to charges of burglary and assault. The United States Attorney’s Office for the Eastern District of Oklahoma announced that Lusk admitted to one count of Burglary in the First Degree in Indian Country and one count of Assault by Strangling, Suffocating, and Attempting to Strangle and Suffocate a Spouse, Intimate Partner, or Dating Partner in Indian Country.
According to the indictment, on March 22, 2024, Lusk unlawfully entered a dwelling with the intent to commit a crime. The indictment also stated that he strangled and suffocated a dating partner during this incident. These events took place in Muskogee County within the Cherokee Nation Reservation boundaries.
The case was investigated by the Federal Bureau of Investigation (FBI), the Cherokee Nation Marshal Service, and the Muskogee Police Department. The plea was accepted by U.S. Magistrate Judge D. Edward Snow at the United States District Court for the Eastern District of Oklahoma. A presentence investigation report has been ordered.
Lusk is currently held by the United States Marshals Service while awaiting sentencing. The prosecution team included Assistant U.S. Attorneys Caila M. Cleary and Morgan Muzljakovich.
