Former university employee charged with interstate sale of stolen Apple products

Michele Beckwith Acting U.S. Attorney | U.S. Attorney for the Eastern District of California

An indictment has been unsealed against Tung Pham, a 59-year-old resident of San Jose, California. Acting U.S. Attorney Michele Beckwith announced the charges, which include conspiracy to transport stolen property across state lines.

Court documents reveal that Pham was employed as a facilities and purchasing coordinator at a public university library in San Jose. In his role, he had access to a university procurement card meant for buying necessary items for the library. However, Pham allegedly used this card to purchase Apple MacBooks and iPads for personal gain. He is accused of selling these products to various individuals, including a co-conspirator residing in Folsom who further resold and shipped them outside California.

The investigation leading to these charges was conducted by the IRS Criminal Investigation and the Federal Bureau of Investigation. Assistant U.S. Attorney Matthew Thuesen is handling the prosecution.

If found guilty, Pham could face up to five years in prison along with a $250,000 fine. The final sentence will be determined by the court based on statutory factors and Federal Sentencing Guidelines, which consider multiple variables. It is important to note that these charges are allegations; Pham remains presumed innocent until proven guilty beyond reasonable doubt.
