Undocumented immigrant indicted on child pornography charge in Missouri

An undocumented immigrant in St. Charles County, Missouri, has been indicted on charges related to child pornography. Francisco J. Ocana-Talamantes, 46, was charged with receiving images of child sexual abuse material via the internet between February 11, 2020, and March 14, 2024.

The indictment does not serve as proof of guilt; all defendants are presumed innocent until proven otherwise. Ocana-Talamantes is currently in custody. A motion has been filed to keep him detained until trial due to his illegal status in the country.

Special Agent in Charge Ashley Johnson of the FBI St. Louis Division stated, “The FBI and our local law enforcement partners had been investigating Franscisco Ocana-Talamantes for his alleged crimes against children.” She added that Ocana-Talamantes' illegal entry into the country allowed the FBI to expedite his federal indictment and arrest through cooperation with U.S. Department of Homeland Security's immigration enforcement.

If convicted, Ocana-Talamantes faces a prison sentence ranging from five to twenty years. The investigation involved collaboration between the FBI, the St. Charles Police Department, and the St. Charles County Cyber Crime Task Force. Assistant U.S. Attorney Jillian Anderson is prosecuting the case.

This legal action is part of Project Safe Childhood, an initiative by the Department of Justice launched in May 2006 to combat child sexual exploitation and abuse online.
