Federal Trade Commission Chairman Andrew N. Ferguson announced that the joint 2023 Merger Guidelines by the FTC and Department of Justice are now in effect. These guidelines will be used as a framework for analyzing mergers.

Chairman Ferguson emphasized the importance of stability within enforcement agencies, stating, “Stability is good for the enforcement agencies. The wholesale rescission and reworking of guidelines is time consuming and expensive,” he said. “We should undertake this process sparingly. We have limited resources to patrol the beat and constant turnover undermines agency credibility.”

The Federal Trade Commission aims to promote competition while protecting and educating consumers. It emphasizes that it will not demand money, make threats, instruct you to transfer money, or promise prizes.
