An amendment has been made to Executive Order 14193, originally issued on February 1, 2025, which addresses the flow of illicit drugs across the northern border. This order was previously amended by Executive Order 14197 on February 3, 2025. The latest amendment revises section 2(h) concerning duty-free de minimis treatment under U.S.C. 1321.

According to the revised section, "Duty-free de minimis treatment under 19 U.S.C. 1321 is available for otherwise eligible covered articles described in subsection (a) and subsection (b) of this section." However, this treatment will end when the Secretary of Commerce notifies the President that systems are adequate to process and collect applicable tariff revenue fully and quickly.

The general provisions of the order state that it does not affect any authority granted by law to an executive department or agency or their heads. It also does not impact the functions of the Director of the Office of Management and Budget related to budgetary, administrative, or legislative proposals.

The implementation of this order will be consistent with applicable laws and subject to available appropriations. Furthermore, it clarifies that no right or benefit is created by this order that is enforceable at law or in equity against the United States or its entities.

This announcement was made from The White House on March 2, 2025.
