Matthew R. Molsen United States Attorney for the District of Nebraska | U.S. Attorney for the District of Nebraska
Acting United States Attorney Matthew R. Molsen has announced the sentencing of two Mexican nationals, Mario Garibay-Reyes, aged 47, and Diego Mendoza-Aguilar, aged 37. They were sentenced in federal court in Omaha, Nebraska, on March 26, 2025, for their role in a conspiracy to distribute and possess with intent to distribute 500 grams or more of methamphetamine mixture. United States District Judge Brian C. Buescher sentenced Garibay-Reyes to 160 months of imprisonment, while Mendoza-Aguilar received a 70-month term. In the federal system, there is no parole, but both men will serve a three-year term of supervised release upon completion of their sentences. As they are illegally present in the United States, they face deportation after their release from prison.
On November 9, 2023, law enforcement used an undercover agent to purchase 414 grams of actual methamphetamine from Mendoza-Aguilar in Omaha. Following this transaction, Mendoza-Aguilar was observed distributing 208 grams of methamphetamine to others. Law enforcement arrested these individuals and confiscated the drugs. It was Garibay-Reyes who supplied Mendoza-Aguilar with the methamphetamine for these drug deals.
A search warrant was executed at Mendoza-Aguilar’s residence in Omaha on November 14, 2024, where Garibay-Reyes was also residing. During the search, authorities found 559 grams of methamphetamine in Garibay-Reyes’s bedroom and 22 grams in Mendoza-Aguilar’s room. Outside the residence, a vehicle belonging to Garibay-Reyes contained 5,718 grams of methamphetamine upon inspection.
The investigation was conducted by the Drug Enforcement Administration as part of an Organized Crime Drug Enforcement Task Forces (OCDETF) operation. OCDETF aims to identify and dismantle serious criminal organizations in the U.S. through a multi-agency approach. More details about OCDETF can be found at https://www.justice.gov/OCDETF.
