Owners of Warwick pain clinic indicted for alleged health care fraud scheme

Two residents of Foster, Rhode Island, Brandon Nowak, 32, and Jason Simmons, 33, have been charged with health care fraud in connection with their Warwick-based pain management clinic, Aim Health. Acting United States Attorney Sara Miron Bloom announced that a federal grand jury indicted the two men on charges of conspiracy to commit health care fraud and fourteen counts of health care fraud.

The indictment claims that Nowak and Simmons engaged in a fraudulent scheme starting in October 2020. Allegedly, they submitted false claims to Medicare, Medicare Advantage, Medicaid Managed Care, and four private insurers for services they did not provide. The accused reportedly misled patients by assuring them that their insurance covered massage therapy, while it did not.

To receive payment, Nowak and Simmons allegedly billed insurance providers for services such as acupuncture, physical therapy, and medical office visits that did not take place. The indictment further accuses them of submitting fraudulent claims for unrelated services including infrared therapy and therapeutic activities.

The court has scheduled the arraignment for April 11, 2025, in the U.S. District Court. It is important to note that an indictment serves merely as an accusation, and the individuals are considered innocent until proven guilty.

Assistant United States Attorney Dulce Donovan, supported by Assistant United States Attorney John P. McAdams, is prosecuting the case. The investigation involved several federal agencies including the U.S. Health and Human Services, Office of Inspector General, the Federal Bureau of Investigations, the Department of Defense Criminal Investigative Service, and the U.S. Department of Veterans Affairs, Office of Inspector General.
