A Honduran national has been sentenced for illegally reentering the United States after deportation. Tomas Rivera-Melgar, aged 39, was apprehended by U.S. Border Patrol and Homeland Security agents at a construction site, where they discovered his prior removals in 2011 and 2016.

He has previous convictions for illegal entry, driving while intoxicated, and assault causing bodily injury. Chief Judge Beaverstock gave him a time-served sentence along with a one-year supervised release post-incarceration. Rivera-Melgar has been held in custody since his arrest on February 26, 2025, and upon release, will be referred to immigration authorities for deportation proceedings. He is also required to pay $100 in special assessments.

The announcement was made by U.S. Attorney Sean P. Costello of the Southern District of Alabama. The investigation involved the Department of Homeland Security, U.S. Border Patrol, and the Immigrations and Customs Enforcement Office. The case was prosecuted by Assistant U.S. Attorney Tandice Blackwood.
