A Guatemalan man has been indicted for illegal re-entry into the United States as announced by Acting U.S. Attorney Michael M. Simpson. The individual, named Neri Osbeli Argueta-Chun, aged 42, was indicted on April 11, 2025, following his re-entry after being previously deported on October 31, 2018. The charges fall under Title 8, United States Code, Section 1326(a), and Title 8, United States Code, Section 1326(b)(1).
If convicted, Argueta-Chun could face up to two years in prison, a possible $250,000 fine, a year of supervised release, and a $100 special assessment fee. Additionally, his prior felony conviction could lead to an enhanced sentence of up to ten years in prison.
Acting U.S. Attorney Simpson emphasized that an indictment should not be viewed as proof of guilt. The defendant’s guilt must be established beyond a reasonable doubt.
This case is part of the broader Operation Take Back America, an initiative by the Department of Justice to combat illegal immigration and criminal organizations. It mobilizes resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETF) and Project Safe Neighborhood (PSN) to combat violent crime.
Acting U.S. Attorney Simpson commended the United States Border Patrol for their role in the investigation. The prosecution of this case is led by Assistant U.S. Attorney Carter K.D. Guice, Jr. of the General Crimes Unit.
