A Guatemalan national, Jose Garcia, 39, has been indicted in Boston for unlawfully reentering the United States following his deportation. He faces one count of unlawful reentry of a deported alien.
According to official documents, Garcia was originally deported from the United States on January 5, 2006. Authorities allege that he reentered the country without authorization at a later date. Immigration and Customs Enforcement (ICE) became aware of his presence in the U.S. after his arrests on July 30, 2022, September 8, 2023, and January 29, 2024.
The offense of unlawful reentry carries a potential penalty of up to two years in prison, one year of supervised release, and a possible fine of $250,000. Sentences are determined by a federal district court judge, guided by the U.S. Sentencing Guidelines and applicable statutes.
The indictment was announced by United States Attorney Leah B. Foley and Patricia H. Hyde, the Field Office Director in Boston for U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations. Assistant U.S. Attorney Brian J. Sullivan of the Narcotics and Money Laundering Unit is leading the prosecution.
