John Felix Cathell III, a resident of French Creek, West Virginia, has admitted to the illegal possession of a firearm. This admission follows an incident in which officers responded to a shooting at a residence. Upon arrival, Cathell disclosed that he had shot his neighbor's dog. Due to previous firearms convictions, Cathell is legally barred from possessing firearms. A subsequent search of his home led to the discovery of several firearms, firearms components, and ammunition.
Cathell could face a sentence of up to 15 years in federal prison. The final sentence will be determined by a federal district court judge after reviewing the U.S. Sentencing Guidelines and other relevant statutory considerations.
The case is being prosecuted by Assistant U.S. Attorney Christie Utt, representing the government's interests. The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Upshur County Sheriff’s Office. The proceedings were overseen by U.S. Magistrate Judge Michael John Aloi.
