The National Federation of Independent Business (NFIB) has responded to the U.S. Department of Labor's (DOL) decision not to enforce the 2024 final rule on independent contractor classification while it is under review. The NFIB, known for advocating on behalf of small businesses, expressed relief over this development.
Beth Milito, Vice President and Executive Director of NFIB’s Small Business Legal Center, commented on the situation: “The DOL’s 2024 rule intensified the stress and confusion of the classification process for small business owners and independent contractors.” She added that NFIB welcomes the decision by the DOL not to enforce the rule at this time, stating that it will allow for a standard that offers more clarity to those affected.
The NFIB has been critical of the 2024 rule, claiming it adds complexity to how workers are classified by small businesses. In response, NFIB joined a lawsuit in the U.S. District Court for the Eastern District of Texas challenging this regulation.
The NFIB Small Business Legal Center continues its efforts to defend small business owners' rights in courts nationwide. Currently, they are involved in over 40 cases across various federal and state courts as well as in the U.S. Supreme Court.
