Mexican citizen arrested for illegal re-entry into the United States

U.S. Attorney Michael DiGiacomo announced the arrest of Jose Guadalupe Mauricio-Rivera, a 33-year-old Mexican citizen, on charges of illegal re-entry into the United States. The criminal complaint against him carries a potential penalty of up to two years in prison and a $250,000 fine.

Assistant U.S. Attorney Colleen M. McCarthy, who is overseeing the case, explained that Mauricio-Rivera was identified by Immigration and Customs Enforcement Office of Enforcement and Removal Operations (ICE-ERO) on April 13, 2025. He was found outside a residence in Warsaw, NY. A records check confirmed his status as an illegal resident in the U.S., leading to his detention. Mauricio-Rivera had previously been deported from the United States in July 2012 and April 2018.

This case falls under Operation Take Back America, an initiative aimed at addressing illegal immigration and combating cartels and transnational criminal organizations (TCOs), with a focus on community safety from violent crime.

Mauricio-Rivera appeared before U.S. Magistrate Judge H. Kenneth Schroeder Jr., where he was detained pending further proceedings.

The investigation was conducted by ICE-ERO under Acting Field Office Director Steven Kurzdorfer's leadership.

It is important to note that being charged with a crime is not evidence of guilt; Mauricio-Rivera remains presumed innocent until proven otherwise.
