Mexican national faces charges for illegal reentry into the U.S. after prior deportations

A Mexican national residing unlawfully in Las Vegas appeared in court on Wednesday to face charges related to his illegal reentry into the United States after previous deportations. Fausto Garcia-Garcia, 44, is charged with one count of being a deported alien found in the United States. A preliminary hearing is set for May 28, 2025, before United States Magistrate Judge Daniel J. Albregts.

The criminal complaint and court statements allege that Garcia-Garcia, a citizen of Mexico, was deported from the United States on January 23, 2003, but later reentered illegally. On December 31, 2024, U.S. Immigration and Customs Enforcement (ICE) discovered his arrest by Las Vegas Metropolitan Police for multiple offenses including Attempt Lewdness by Person Over 18 with Child Less Than 14 and Sexual Assault Against Child Less Than 14. Subsequently, on May 1, 2025, he was placed in ICE custody from the Clark County Detention Center due to an immigration detainer.

If convicted of the charges against him, Garcia-Garcia could face up to two years in prison along with a one-year term of supervised release. He may also be subject to a $250,000 fine and a $100 special assessment.

The announcement was made by United States Attorney Sigal Chattah for the District of Nevada and Salt Lake City Field Office Director Michael Bernacke. The investigation was conducted by ICE's Salt Lake City office and its Las Vegas Sub-Office; prosecution is handled by the United States Attorney’s Office for the District of Nevada.
