ICE arrests UK citizen in New York for undisclosed criminal record

U.S. Immigration and Customs Enforcement (ICE) officers have arrested a British national, Orlando Duncan Da Silva Bain, in Niagara Falls, New York. The arrest occurred on May 7 during a targeted enforcement operation by ICE Buffalo officers.

Da Silva Bain, aged 19, entered the United States as a nonimmigrant through Orlando, Florida. He failed to disclose his criminal record from the United Kingdom on his Electronic System for Travel Authorization application. This omission constitutes a violation of the terms of admission under the visa waiver program, making him subject to removal from the U.S.

Following his entry into the country, authorities discovered that Da Silva Bain had been convicted of several offenses in the U.K., including taking a child to keep them from lawful control and engaging in penetrative sexual activity with a minor. Other convictions include causing or inciting the sexual exploitation of a child aged 13-17, possessing indecent photographs or pseudo-photographs of a child, causing a child aged 13 to 15 to watch or look at an image of sexual activity by an offender aged 18 or over, and sending obscene or indecent articles via postal service.

Currently held at the Buffalo Federal Detention Facility, Da Silva Bain awaits removal proceedings from the United States.
