Honduran man indicted for illegal re-entry into the United States

Erik Roberto Machado-Mencia, a 36-year-old Honduran national, has been indicted for re-entering the United States after deportation. The announcement was made by Acting U.S. Attorney Michael M. Simpson on May 22, 2025.

The indictment states that Machado-Mencia was discovered in the U.S. on May 15, 2025, without authorization from the Attorney General, following his previous deportation on December 16, 2019.

Machado-Mencia faces potential penalties including up to two years of imprisonment, a fine reaching $250,000, up to one year of supervised release, and a mandatory special assessment fee of $100.

Acting U.S. Attorney Simpson emphasized that an indictment is only a charge and that guilt must be established beyond reasonable doubt.

This case falls under Operation Take Back America, an initiative aimed at combating illegal immigration and transnational criminal organizations while safeguarding communities from violent crime. This operation utilizes resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).

Simpson commended the United States Border Patrol for their investigation efforts. Assistant United States Attorney Carter K.D. Guice Jr. is leading the prosecution.
