Federal charges have been filed against Jon Patrick Kubler, a 52-year-old resident of Redondo Beach, California, for allegedly orchestrating a $4 million investment fraud scheme. The announcement was made by U.S. Attorney Russ Ferguson, alongside James C. Barnacle, Jr., Acting Special Agent in Charge of the FBI in North Carolina.
The criminal indictment alleges that between December 2017 and April 2023, Kubler defrauded approximately 30 investors through an investment scheme targeting elderly and vulnerable individuals. Despite lacking a license as an investment adviser, Kubler is accused of providing investment planning services to unsophisticated investors and making false representations to induce them into investing in commercial real estate through his companies, Aksarben Evolution, LLC and Green Saddle, LLC.
Kubler allegedly employed Ponzi-style tactics by using funds from new investors to pay existing ones while misrepresenting these payments as profits from successful investments. It is further alleged that he used investor money for personal expenses.
In 2022, one victim reportedly received a letter from the U.S. Securities and Exchange Commission (SEC) regarding its investigation into Kubler's activities. To conceal the ongoing investigation, Kubler allegedly misled the victim about the nature of the SEC's inquiry.
Kubler faces charges of securities fraud and transactional money laundering. If convicted, he could face up to 20 years in prison for securities fraud and an additional 10 years for money laundering. Sentencing will be determined by a federal district court judge based on U.S. Sentencing Guidelines and other factors.
U.S. Attorney Ferguson expressed gratitude to the FBI in Charlotte for their role in investigating the case.
Alongside criminal proceedings, the SEC obtained a temporary asset freeze and other emergency measures against Kubler in September 2023 for engaging in a Ponzi scheme that misused investor funds. In January 2025, a final judgment permanently enjoined Kubler from violating securities laws and required him to pay disgorgement and civil penalties.
Special Assistant U.S. Attorney Eric Frick and Assistant U.S. Attorney Graham Billings are leading the prosecution efforts.
It is important to note that all charges are allegations at this stage; Jon Patrick Kubler is presumed innocent until proven guilty beyond reasonable doubt in court.
