US files lawsuit against AIMA over alleged fraudulent Medicare claims

Hayden O’Byrne United States Attorney for the Southern District of Florida | The Florida Bar

The United States government has initiated legal action under the False Claims Act against AIMA Business and Medical Support, LLC (AIMA), accusing the company of submitting false claims to Medicare. The allegations focus on genetic laboratory tests deemed medically unnecessary.

AIMA, a Florida-based limited liability company, provides medical billing and compliance services across the United States. The company's CEO, Aaron Liston, operates from the United Kingdom while its employees are based in India. AIMA's operations include billing Medicare on behalf of U.S.-based healthcare providers and suppliers.

The complaint alleges that between August 2018 and August 2019, AIMA billed approximately $15,178,946 to Medicare Part B for genetic tests conducted by Excellent Laboratories Inc., also known as Selecta Laboratory. It is claimed that these tests were not ordered by a physician treating the patient and were therefore not necessary according to Medicare guidelines. Consequently, Selecta received payments from Medicare which it was not entitled to receive.

U.S. Attorney Hayden P. O’Byrne for the Southern District of Florida announced the filing along with Acting Special Agent in Charge Jesus Barranco from the U.S. Department of Health and Human Services Office of Inspector General (HHS-OIG). Assistant U.S. Attorney Clarissa Pinheiro is overseeing this case with support from HHS-OIG investigators.

This case underscores governmental efforts to tackle healthcare fraud using tools like the False Claims Act. Individuals can report potential fraud or mismanagement to HHS at 800-HHS-TIPS (800-447-8477).

It should be noted that these are currently only allegations without any established liability.
