Arizona Legislature passes bill targeting antisemitism in education

The Arizona House has given final approval to HB2867, known as the Antisemitism in Education Act. The bill, sponsored by State Representative Michael Way, now awaits the governor's signature. It aims to prevent antisemitic conduct in Arizona's public schools and colleges and establishes disciplinary procedures for violations.

The legislation prohibits educators from promoting antisemitism or requiring students to support antisemitic views for academic credit or advancement. Additionally, it bans the use of public funds for antisemitic instruction or programming. Reports of violations must be investigated by school officials within 30 days, with appeals possible through a school board or the Arizona Board of Regents. Legal action can only be pursued after administrative options are exhausted.

"Arizona’s students and teachers deserve to learn and work in an environment free from antisemitic hate," said Representative Way. "This bill ensures schools are places of learning, not battlegrounds for political indoctrination."

HB2867 aligns with the IHRA definition of antisemitism recognized by the U.S. Department of State and protects education on Jewish history, the Holocaust, and Israel without infringing on First Amendment rights.

Representative Way emphasized that this bill supports the House Republican Majority Plan's goal to enhance public safety by addressing antisemitic threats in education. "This should be an easy decision for the governor," he said. "The Legislature has done its job. The public supports this. Now it’s up to the governor to do hers and show that Arizona won’t tolerate antisemitism in public education."

Michael Way represents Legislative District 15, which includes Mesa and Queen Creek in Maricopa County, and San Tan Valley in Pinal County.
