The United States Attorney’s Office has announced that a federal grand jury in the Northern District of Ohio has indicted two Mexican nationals for illegal reentry into the United States. These indictments are separate cases and not related to each other.

Pedro Martinez-Garcia, 28, faces one count of illegal reentry. He was previously removed from the U.S. twice, with the last removal on October 11, 2017. On June 1, 2025, he was found in Marion, Ohio without authorization from the U.S. Attorney General or Secretary for Homeland Security.

Bersain Alvarez-Lopez, 37, is charged with one count of illegal reentry after being removed three times previously; his last removal occurred on January 15, 2019. He was located again in Norwalk, Ohio on May 9, 2025 without permission to be readmitted. Additionally, Alvarez-Lopez faces charges for possessing fraudulent identification documents—a permanent resident card and a Social Security card—in violation of Title 18 USC 1546 (a). He is also charged with misuse of a Social Security Number under Title 42 USC 408 (a)(7)(B).

The investigations leading to these indictments were conducted by U.S. Immigration and Customs Enforcement along with U.S. Customs and Border Protection. Assistant U.S. Attorney Ava Rotell Dustin is handling the prosecution.

It is important to note that an indictment is merely a charge and does not constitute evidence of guilt. Both defendants are entitled to fair trials where it will be up to the government to prove their guilt beyond a reasonable doubt.

Should they be convicted, sentencing will be determined by the Court based on factors specific to each case such as prior criminal records and details surrounding the offenses.

These cases fall under Operation Take Back America—an initiative by the Department of Justice aimed at addressing illegal immigration issues and protecting communities from crime associated with cartels and transnational organizations.
