President calls National Guard amid threats against federal functions

Numerous incidents of violence and disorder have recently arisen in response to the enforcement of Federal law by U.S. Immigration and Customs Enforcement (ICE) and other government personnel. These events pose a threat to Federal immigration detention facilities and other properties. The President has deemed these acts as a form of rebellion against the authority of the U.S. Government.

In response, the President has invoked his constitutional authority to call members and units of the National Guard into Federal service under 10 U.S.C. 12406. This move aims to protect ICE, government personnel, and Federal property at locations where protests are occurring or expected based on current threat assessments.

The Secretary of Defense is tasked with coordinating with state Governors and the National Guard Bureau to identify appropriate members for this duty. At least 2,000 National Guard personnel will be called into service for a duration of 60 days or as decided by the Secretary of Defense. Additionally, regular Armed Forces members may be employed as needed to support this mission.

The deployed military personnel are authorized to perform protective activities necessary for ensuring safety. Consultation between the Secretary of Defense, Attorney General, and Secretary of Homeland Security is required before withdrawing any personnel from their assigned locations.

Authority conferred by this memorandum can be delegated by the Secretaries of Defense and Homeland Security to subordinate officials within their departments.
