U.S. Attorney Michael DiGiacomo has announced the arrest of Tre Smitherman, a 31-year-old resident of North Tonawanda, New York. Smitherman faces charges related to drug distribution and firearm possession, as outlined in a criminal complaint. The charges include possession with intent to distribute cocaine, possession of a firearm in furtherance of a drug crime, and being a felon in possession of a firearm. If convicted, Smitherman could face penalties ranging from a mandatory minimum of five years in prison to life imprisonment and up to $1 million in fines.
Assistant U.S. Attorney Jeffrey E. Intravatola is handling the case. According to the complaint, on November 6, 2024, the Niagara County Drug Task Force executed search warrants at Smitherman's residence on Oliver Street and his vehicle. The searches yielded significant findings: a loaded pistol, quantities of cocaine and methamphetamine, drug paraphernalia, and $3,789 in cash were recovered by investigators.
Smitherman's legal troubles are compounded by his previous felony conviction in New York State Court in 2014 which prohibits him from possessing firearms.
The investigation leading to these charges was conducted by the Niagara County Drug Task Force under Sheriff Michael Filicetti's direction and the Bureau of Alcohol, Tobacco, Firearms and Explosives led by Special Agent-in-Charge Bryan Miller from the New York Field Division.
It is important to note that while charges have been filed against Smitherman, he remains innocent until proven guilty in court proceedings.
