U.S. Attorney Michael DiGiacomo has announced that Timothy Tundo, a 62-year-old resident of Bethany, New York, has pleaded guilty to several charges. These include possession with intent to distribute LSD, possession of firearms in furtherance of drug trafficking, and unlawful possession of machine guns. The offenses carry a mandatory minimum sentence of five years and could result in a maximum penalty of life imprisonment.
Assistant U.S. Attorneys Joshua A. Violanti and Stacey Jacovetti are managing the case. They reported that law enforcement executed a search warrant at Tundo’s residence in February 2021. The search revealed that Tundo was using his home to manufacture and distribute controlled substances. Authorities confiscated quantities of LSD, oxycodone, marijuana, two machine guns, three assault weapons, 12 long guns, five pistols, a cap gun, ammunition, magazines, $2,500 in cash, and drug paraphernalia.
The investigation leading to this plea was conducted by the Genesee County Sheriff's Office under Sheriff Joseph Graff's direction and the Bureau of Alcohol, Tobacco, Firearms and Explosives led by Special Agent-in-Charge Bryan Miller from the New York Field Division.
Tundo is scheduled for sentencing on November 14th at 9:30 a.m., presided over by Judge Lawrence J. Vilardo.
