Leah B. Foley United States Attorney for the District of Massachusetts | Department of Justice

An El Salvadoran national, Miguel Angel Ortiz-Rivera, has been indicted by a federal grand jury in Boston for unlawfully reentering the United States after deportation. Ortiz-Rivera, aged 39, faces one count of unlawful reentry of a deported alien following his arrest by immigration authorities on May 24, 2025.

The indictment states that Ortiz-Rivera was last deported from the United States to El Salvador on March 11, 2015. It is alleged that he illegally returned to the U.S. without permission sometime after this date. Prior to this incident, Ortiz-Rivera had been deported twice before: once in November 2011 and again in April 2013.

If convicted of unlawful reentry of a deported alien, Ortiz-Rivera could face up to two years in prison, one year of supervised release, and a fine of up to $250,000. Additionally, he will be subject to deportation upon completing any sentence imposed. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.

The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston. The case is being prosecuted by Assistant U.S. Attorney Alexandra W. Amrhein from the Major Crimes Unit.

It is important to note that the details contained in the charging documents are allegations at this stage. The defendant is presumed innocent unless proven guilty beyond a reasonable doubt in a court of law.
