Washington state resident sentenced for burglary and felony assault

MUSKOGEE, OKLAHOMA – Cody Lynn Lusk, a 35-year-old resident of Seattle, Washington, has been sentenced to 84 months in prison for burglary in the first degree in Indian Country. He was also sentenced to 30 months for assaulting a spouse, intimate partner, or dating partner by strangling and suffocating them in Indian Country.

The case was investigated by the Federal Bureau of Investigation, the Cherokee Nation Marshal Service, and the Muskogee Police Department. Lusk pleaded guilty on February 3, 2025.

According to investigators, Lusk broke into an apartment in Muskogee on March 22, 2024, with the intent to attack the resident. During the incident inside the apartment, he strangled and suffocated the victim. The victim managed to escape and call for help during a pause in the attack. The crimes took place within Muskogee County on the Cherokee Nation Reservation.

The hearing was presided over by Chief U.S. District Judge Ronald A. White at the United States District Court for the Eastern District of Oklahoma. Lusk will remain under U.S. Marshals Service custody until he is transported to a designated United States Bureau of Prisons facility to serve his non-paroleable sentence.
