A Mexican national residing illegally in Tyler, Texas, has been indicted for a federal firearms violation. Acting U.S. Attorney Jay R. Combs announced that Marco Imanol Ferrusca-Ortega, 23, faces charges of being an illegal alien in possession of a firearm. The indictment was returned by a federal grand jury in the Eastern District of Texas.
According to the indictment, Ferrusca-Ortega was found on July 8, 2025, illegally in the United States and possessing a firearm. This case is part of Operation Take Back America, which aims to address illegal immigration and combat transnational criminal organizations and violent crime through coordinated efforts by the Department of Justice.
If convicted, Ferrusca-Ortega could face up to 15 years in federal prison and subsequent deportation. The investigation involves multiple agencies including the Bureau of Alcohol, Tobacco, Firearms and Explosives; U.S. Drug Enforcement Administration; Homeland Security Investigations; and Tyler Police Department. Assistant U.S. Attorney Dustin Farahnak is prosecuting the case.
The announcement emphasizes that a federal indictment is not proof of guilt and all defendants are considered innocent until proven guilty beyond reasonable doubt in court.
