Brazilian national charged with illegal reentry after prior deportation

A Brazilian national living in Framingham has been charged with illegal reentry into the United States. Joelson Gomes Fonseca, 39, faces one count of unlawful reentry of a deported alien.

According to court documents, Fonseca was deported in March 2008 following a conviction for an aggravated felony. The charge carries a potential sentence of up to 20 years in prison, three years of supervised release, and a fine of up to $250,000. Upon completion of any sentence imposed, Fonseca may face deportation again. Sentencing will be determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.

The announcement was made by United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston. First Assistant U.S. Attorney Katherine Ferguson is handling the prosecution.

It is important to note that the allegations are contained within charging documents, and Fonseca is presumed innocent until proven guilty beyond a reasonable doubt in court.
