Guatemalan national sentenced for illegal reentry and failure to register as sex offender

A Guatemalan national previously convicted of second degree sexual assault in Rhode Island and deported in 2014 was sentenced in federal court for illegally reentering the United States and failing to register as a sex offender, according to Acting United States Attorney Sara Miron Bloom.

Court documents indicate that Nelson Leonel Yocute Samayoa, 34, also known as Marvin Gomez, returned to the U.S. after his deportation and resided in Newport for about nine years without registering as a sex offender as required by his 2014 conviction.

Yocute has been detained since June 23, 2025. On September 4, he was sentenced by U.S. District Court Judge Mary S. McElroy to time served and five years of supervised release. He remains in federal custody pending deportation proceedings.

Assistant United States Attorney Denise M. Barton prosecuted the case. The investigation involved the Newport Police Department with assistance from Homeland Security Investigations and the United States Marshals Service.
