Court appoints Theodore S. Hertzberg as U.S. attorney for Northern District of Georgia

Theodore S. Hertzberg will continue to serve as United States Attorney for the Northern District of Georgia following a vote by judges of the United States District Court. The decision allows him to remain in the role indefinitely until a successor is confirmed.

“I am deeply honored that the Court has entrusted me with the continued leadership of the United States Attorney’s Office,” said U.S. Attorney Hertzberg. “I pledge that the prosecutors under my charge will act decisively and aggressively to excise dangerous offenders from our community, and our litigators will represent the interests of the United States zealously. The citizens of the Northern District deserve nothing less.”

Hertzberg was initially appointed as U.S. Attorney on May 13, 2025, by Attorney General Pamela Bondi under provisions set forth by the Federal Vacancies Reform Act and 28 U.S.C. § 546(c)(2), which limits such appointments to 120 days. With his term set to expire, Monday's court vote enables him to continue serving until a Presidentially appointed successor is confirmed.

Chief United States District Judge Leigh Martin May administered Hertzberg’s oath of office at a ceremony attended by staff from the U.S. Attorney’s Office, judges, federal law enforcement officers, and court personnel.

As chief law enforcement officer for a district covering 46 counties and over seven million residents in northern Georgia, Hertzberg oversees prosecution of federal crimes and civil litigation involving the United States. The office collaborates with various law enforcement agencies at multiple levels.

Since his appointment in May, Hertzberg has directed efforts against transnational criminal organizations, violent offenders, drug traffickers, and cybercriminals. He has also focused on combating fraud and abuse involving federal funds, leading to criminal charges and significant civil settlements.

Hertzberg’s prior experience includes nearly ten years as an Assistant U.S. Attorney in both Savannah and Atlanta offices within Georgia. His background features prosecution of violent criminals and financial crimes as well as courtroom involvement even after assuming leadership responsibilities.

Before joining government service, he worked at Kramer Levin Naftalis & Frankel LLP in New York and clerked for Judge Kristi K. DuBose in Alabama’s Southern District Court. He holds degrees from Amherst College and New York University School of Law.
