Emma Mittelstaedt Burnham has been appointed as Associate Director for Healthcare in the Bureau of Competition at the Federal Trade Commission. The announcement was made by FTC Chairman Andrew N. Ferguson.
“I am delighted to appoint Emma as Associate Director for Healthcare in the Bureau of Competition. She is a talented attorney with many years of experience at the Department of Justice as a senior antitrust enforcer,” said FTC Chairman Andrew N. Ferguson. “Emma will be an invaluable champion in the FTC’s ongoing fight to protect Americans’ access to affordable, high-quality healthcare.”
Burnham brings more than a decade of experience from the U.S. Department of Justice Antitrust Division, where she spent 11 years working on complex antitrust cases and most recently served as Director of Criminal Enforcement overseeing price-fixing investigations across the country. Her previous roles included Trial Attorney, Counsel to the Assistant Attorney General, Assistant Chief, and Acting Chief.
Her work at DOJ involved prosecuting antitrust violations within healthcare and leading investigations into cartels in the generic pharmaceutical industry. These efforts resulted in significant corporate prosecutions, including record-setting criminal penalties for domestic cartel offenses and the first instance where divestiture was used as part of a criminal settlement.
Prior to her tenure at DOJ, Burnham worked as a criminal defense associate at law firms located in Washington, DC, and Los Angeles. She earned her law degree with honors from the University of Chicago Law School and Georgetown University and clerked for Judge Robert W. Gettleman in Illinois.
