Honduran national sentenced for illegal reentry after prior deportation

Sean P. Costello U.S. Attorney | U.S. Attorney for the Southern District of Alabama

A Honduran national, Rigoberto Rubi-Guevara, 38, has been sentenced to four months in prison for illegally reentering the United States after being previously deported. The sentencing took place in Mobile, Alabama.

Court documents show that Rubi-Guevara was a passenger in a vehicle stopped by the Mobile County Sheriff’s Office on September 12, 2025, due to a traffic violation. Deputies suspected that he was not a U.S. citizen and contacted U.S. Border Patrol. A Border Patrol agent confirmed that Rubi-Guevara had been removed from the United States in 2011.

Chief U.S. District Judge Jeffrey Beaverstock imposed a sentence of time served and ordered a one-year term of supervised release following his release from prison. After serving his sentence, Rubi-Guevara will be referred to immigration officials for deportation proceedings. He was also ordered to pay $100 in special assessments.

U.S. Attorney Sean P. Costello of the Southern District of Alabama announced the sentencing.

The case was investigated by several agencies including the Department of Homeland Security, Homeland Security Investigations, Immigrations and Customs Enforcement, and the Baldwin County Sheriff’s Department.

Assistant U.S. Attorney John P. Hutchins III prosecuted the case for the United States.

According to officials, this prosecution is part of Operation Take Back America, which aims to use all resources of the Department of Justice to address illegal immigration, eliminate cartels and transnational criminal organizations, and protect communities from violent crime perpetrators.
