Two Mexican nationals have been sentenced to 39 days in prison each for illegally reentering the United States, according to an announcement from U.S. Attorney Kurt Alme.
Victor Manuel Uribe Luna, 35, and David Suarez-Olivera, 45, pleaded guilty in November 2025 to a single count of illegal reentry. Chief U.S. District Judge Brian M. Morris oversaw the proceedings.
Court documents indicate that on November 2, 2025, law enforcement stopped a vehicle off U.S. Highway 2 near Malta. The car contained three individuals; only two initially presented identification. Victor Manuel Uribe Luna was identified as the driver with a California Driver’s License. One passenger was identified as Suarez-Olivera. All three were determined to be in the country illegally.
A records check revealed that Uribe Luna had previously been removed from the United States on January 13, 2021, and lacked legal documentation to enter or remain in the country. Similarly, Suarez-Olivera had been formally removed on January 26, 2006, and is prohibited from re-entering.
During processing, both men admitted to being citizens and nationals of Mexico without legal authorization to enter or stay in the United States. They also acknowledged crossing into the country illegally without inspection by an Immigration Officer at a designated Port of Entry.
The case was prosecuted by the U.S. Attorney’s Office following an investigation by U.S. Border Patrol and Phillips County Sheriff’s Office.
"This case is part of Operation Take Back America a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime," according to the press release.
