The Subcommittee on Indian and Insular Affairs convened an oversight hearing to discuss the modernization of federal support for 638 contracting within the Indian Health Service (IHS). The focus was on addressing challenges that tribes face in managing their own health programs under the Indian Self-Determination and Education Assistance Act (ISDEAA).
Subcommittee Chair Jeff Hurd (R-Colo.) commented, “Self-governance works when the federal government provides the support tribes need to manage their own health programs. Right now, delays and inconsistent processes are creating unnecessary barriers. Today’s hearing focused on whether IHS’ realignment will address these challenges and strengthen the agency’s ability to support tribal self-determination across all Office Areas.”
638 contracting allows tribes greater control over health care delivery by enabling them to manage their own programs. However, many tribes encounter obstacles such as slow contract amendments, uncertain review procedures, and administrative backlogs. These issues have become more pressing as additional tribes seek to take on management of their health services.
To address these concerns, IHS is implementing a significant realignment aimed at improving consistency among Area Offices and enhancing technical assistance for tribes. This initiative began during the Trump administration with goals to streamline processes, clarify roles within IHS, and provide better support for tribal self-governance.
