Congressman Brett Guthrie, Chairman of the House Committee on Energy and Commerce, and Congressman Gary Palmer, Chairman of the Subcommittee on Environment, have announced an upcoming hearing to address concerns about the Environmental Protection Agency’s (EPA) designation of two PFAS chemicals as hazardous substances under the Superfund law.
The hearing, titled "Examining the Impact of EPA’s CERCLA Designation for Two PFAS Chemistries and Potential Policy Responses to Superfund Liability Concerns," will take place on Thursday, December 18, 2025, at 10:00 AM ET in Room 2123 of the Rayburn House Office Building. The event is open to both the public and press and will be live streamed online at energycommerce.house.gov.
Chairmen Guthrie and Palmer stated, “We’ve heard from many stakeholders who do not produce or use PFAS, but encounter these substances passively through their essential work managing residential waste, growing food, or bringing clean water to our homes. Federal actions have caused concerns about potential liability in the wake of EPA’s designation of two PFAS chemicals as hazardous substances under the Superfund law. This hearing is an opportunity to assess the current statutory and regulatory landscape for PFAS and consider what steps Congress may need to take to respond to these concerns.”
The hearing aims to review how federal regulations impact individuals and organizations that come into contact with PFAS chemicals indirectly. It will also explore possible legislative responses regarding liability issues connected with the EPA's recent actions.
