A federal grand jury has indicted Joshua Mahley, 42, of Gasport, New York, on six counts including interstate travel to engage in illicit sexual conduct, transportation of a minor, penalties for registered sex offenders, and possession of obscene visual representations involving the sexual abuse of children. The charges could result in a maximum sentence of life in prison.
U.S. Attorney Michael DiGiacomo announced the indictment. Assistant U.S. Attorney Colleen M. McCarthy explained that Mahley was previously convicted in December 2010 in Orleans County Court for Rape in the Second Degree, Sexual Intercourse by Person 18 or More with Person Less than 15, and Sexual Abuse in the Second Degree. He is a registered sex offender in New York State.
According to the indictment, Mahley allegedly traveled across state lines on three occasions—in June, July, and August 2025—to engage in illicit sexual conduct with a minor victim. In September 2025, he is accused of transporting the minor victim across state lines for sexual activity. On September 8, 2025, Mahley also allegedly possessed computer and AI-generated images depicting minors engaged in sexually explicit conduct.
The investigation was conducted by the Niagara County Sheriff’s Office and the Federal Bureau of Investigation.
“The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty,” according to the announcement from authorities.
