Mexican national sentenced for illegal reentry after firearm incident in Alabama

A Mexican national, Hernandez-Modesto, was sentenced to time served in prison for illegally reentering the United States after being deported in 2020. The sentencing took place in Mobile, Alabama.

On October 18, 2025, officers from the Gulf Shores Police Department responded to a report of gunshots and found that Hernandez-Modesto, age 38, had fired a weapon several times. After his arrest, local police contacted Homeland Security Investigations and Immigration and Customs Enforcement. These agencies confirmed that Hernandez-Modesto had previously been removed from the country.

Judge Dubose issued a sentence of time served along with a one-year term of supervised release following Hernandez-Modesto’s release from prison. He will be referred to immigration officials for deportation proceedings and was ordered to pay $100 in special assessments.

U.S. Attorney Sean P. Costello of the Southern District of Alabama announced the sentence. The case was investigated by the Department of Homeland Security, Homeland Security Investigations, Immigrations and Customs Enforcement, and the Gulf Shores Police Department. Assistant U.S. Attorney John P. Hutchins III prosecuted the case.

According to the announcement: "This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime."
