Cesar Briseno Mauricio, a 26-year-old Mexican national, has pleaded guilty to unlawful reentry of a removed alien in the Eastern District of Oklahoma. According to the United States Attorney’s Office for the Eastern District of Oklahoma, Mauricio was found in Love County without legal authorization after having previously been removed from the country on March 18, 2020.
The charge carries a potential sentence of up to two years in prison and a fine that could reach $250,000. The case was investigated by the U.S. Department of Homeland Security’s Immigration and Customs Enforcement Division and the Oklahoma Highway Patrol.
Officials allege that Mauricio did not obtain permission from the Secretary of Homeland Security before reentering the United States. The prosecution is part of Operation Take Back America, which is described as “a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.”
U.S. Magistrate Judge Jason A. Robertson accepted Mauricio’s plea and ordered a presentence investigation report. Sentencing will be determined by a U.S. District Court Judge who will consider federal sentencing guidelines along with other statutory factors.
Mauricio will remain in custody with the United States Marshals Service until sentencing. Assistant U.S. Attorneys Jonathan E. Soverly and Nicole Paladino are prosecuting the case.
