Anthony Neubauer, a 39-year-old resident of Falconer, New York, has been sentenced to 20 years in prison for his involvement in a kidnapping that led to the murder of Joseph Anthony. The sentencing was handed down by U.S. District Judge Elizabeth A. Wolford, following Neubauer's conviction for aiding and abetting a kidnapping.
According to Assistant U.S. Attorneys Michael J. Adler and Timothy C. Lynch, on May 27, 2014, Neubauer and Matthew Rudy lured Joseph Anthony from Jamestown, New York, to Rudy’s property in Pennsylvania with the promise of cocaine. Once there, they revealed that there was no cocaine and proceeded to shoot and kill Anthony before burying him on the property. The motive for the crime was their belief that Anthony was cooperating with law enforcement.
Matthew Rudy had previously been convicted and sentenced in connection with this case.
U.S. Attorney Michael DiGiacomo commented on the outcome: “Anthony Neubauer and his co-defendant went to great lengths to silence a person they believed was cooperating in a law enforcement investigation, including kidnapping, crossing state lines, murder and disposing of a body. A lot of time may have passed, but our law enforcement partners demonstrated perseverance and unwavering determination, which ultimately resulted in uncovering Neubauer’s actions. As a consequence, he will now spend the next two decades in prison.”
Philip Tejera, Special Agent-in-Charge of the FBI’s Buffalo Field Office added: “Today’s sentencing of Anthony Neubauer reflects the FBI’s unwavering commitment to pursuing justice, no matter how much time has passed. When the Jamestown Police Department requested assistance with this cold case murder investigation, the FBI surged resources across Western New York and northern Pennsylvania. By combining investigative technology and proven tactics, we were able to secure justice for the victim and his family.”
The investigation involved collaboration between the Jamestown Police Department under Interim Chief Scott D. Forster; the Federal Bureau of Investigation led by Special Agent-in-Charge Philip Tejera; as well as support from the Warren County District Attorney’s Office in Pennsylvania.
